Acceptable Use Policy
Cloud Host Cafe provides hosting services to clients worldwide, and we have a responsibility to protect each client and to provide the best services available. All registered clients of Cloud Host Cafe (cloudhostcafe.com) agree to and are subject to our Terms of Service, Privacy Policy and the following Acceptable Use Policy:
All services provided by Cloud Host Cafe may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any United States Federal, State or City law is prohibited. Services provided by Cloud Host Cafe that reside outside of the United States must still abide these terms and must not be in violation of any relevant laws of hosting city, state and country. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene, or material protected by trade secret and other statute. The subscriber agrees to indemnify and hold harmless Cloud Host Cafe and its employees from any claims resulting from the use of the service which damages the subscriber or any other party. Our acceptable use policy is actively and strictly enforced. Offending material or users are suspended and/or terminated from our network with or without prior notice.
Clients acknowledge that the service provided is of such a nature that service can be interrupted for many reasons other than the negligence of Cloud Host Cafe and that damages resulting from any interruption of service are difficult to ascertain. Therefore, clients agree that Cloud Host Cafe shall not be liable for any damages arising from such causes beyond the direct and exclusive control of Cloud Host Cafe.
Subscriber further acknowledges that Cloud Host Cafe’s liability for its own negligence may not in any event exceed an amount equivalent to charges payable by subscriber for services during the period damages occurred. In no event shall Cloud Host Cafe be held liable for any special or consequential damages, loss or injury.
Illegality of any form, including but not limited to the unauthorized distribution or copying of copyrighted software or other data, harassment, fraud and trafficking obscene material. Certain types of content are not allowed on our network. We do not host illegal adult content of any description including but not limited to content involving children, animals or involuntary particicpants. Content relating to Hacking, Cracking, Warez and IRC is not allowed. Software, audio and video downloads may only be hosted if you are the writer and copyright owner of the resources or you have a right to distribute the materials. Mail spam/abuse is not tolerated and will result in an instant suspension of the infringing service. Accounts/services suspended due to content or acceptable use policy violations are not refunded under any circumstances.
The following are prohibited to be on our entire network. Using or doing them on any of our products/services will result in an account and/or server suspension and/or termination with or withouout prior notice. We reserve the right to add and/or remove items on this list without notifying the client.
Whilst our network is often able to mitigate DDoS attacks, clients who are targeted with frequent and/or disruptive attacks may have action taken against them at our discretion. If your website(s) and/or VPS(s) are found to be degrading the connection speed of other clients, you will be contacted via ticket and notified to reduce your usage.
Unlimited or Unmetered resources expectedly have software and physical limits, and are subject to a moral fair usage policy. If you are using more of involved resource than is considered realistic or reasonable then you will be notified of this, and if in our discretion it is severe enough then action may be taken against you.
All accounts are isolated under CloudLinux virtualization. The server resources allocated within our packages are not dedicated to you nor do you have the right to use all the resources. These are in place to prevent attacks and/or abuse from affecting other customers on the same host node. If you are consistently reaching these limits, we may ask you to upgrade to a more suitable service such as a VPS. We reserve the right to alter these limits without prior notice and the right to suspend accounts who are consistently reaching their maximum limits. Please open a support ticket if you’re hitting your limits.
All cPanel accounts on our Shared & Reseller plans have a soft limit of 180,000 inodes and a hard limit of 200,000. Which when reached will result in you being denied access to write anymore files to disk. In computing, an inode is a data structure on a traditional Unix-style file system such as UFS. An inode stores basic information about a regular file, directory, or other file system object. (One inode is equal to 1 file, such as an image)
Outgoing mail on our cPanel host nodes are limited to 500 emails per hour, this includes mailman lists and PHP mail. We reserve the right to alter this limit at any time.
All web hosting servers run daily backups of cPanel accounts. This process happens during off-peak hours and may cause a decrease in server performance. We are not responsible for any performance decrease during the process, nor is it included within our uptime guarantee. We provide these backups as an emergency fail-safe and cannot guarantee their availability.
